Terms and Conditions
The rules that govern access to and use of Orkata, including customer content, AI outputs, plugins, billing, acceptable use, and account termination.
Effective July 12, 2026
These Terms and Conditions (the Terms) govern access to and use of orkata.co, the Orkata dashboard, public chatbot pages, embedded widgets, plugins, APIs, documentation, and related services (collectively, the Service).
By creating an account, purchasing a plan, configuring a chatbot, or otherwise using the Service, you agree to these Terms. If you use the Service for a business or organization, you represent that you have authority to bind that organization, and “you” includes that organization.
1. Eligibility and accounts
You must be at least 18 years old or otherwise have legal capacity to enter a binding agreement. Accounts currently use Google sign-in. You are responsible for:
- Providing accurate account and billing information
- Maintaining control and security of your Google account
- All chatbot, source, plugin, and billing activity performed through your account
- Promptly notifying us if you suspect unauthorized access
Accounts and chatbots are associated with the signing-in Google account. Self-service team invitations and account transfers may not be available. Contact support@orkata.co when ownership or access needs to change.
2. The Service
Orkata lets customers create AI chatbots, add and index knowledge sources, test model behavior, publish standalone or embedded chat experiences, review chat logs, and configure buttons, forms, and HTTP actions.
Features, model availability, limits, and provider integrations can change. Preview, evaluation, beta, or experimental features may be incomplete, change without notice, or be withdrawn. Unless a separate written agreement states otherwise, we do not promise a specific uptime, response time, support level, model, or feature roadmap.
3. Customer responsibilities
You are responsible for the chatbots you create and how they are presented to visitors. You must:
- Provide accurate instructions and current knowledge sources
- Review important answers and test the chatbot before publishing it
- Give visitors appropriate notices and obtain any consent required for chat logging, forms, plugins, or other personal-data processing
- Provide a reasonable human-support path when the chatbot is not appropriate
- Ensure your use complies with privacy, consumer, employment, intellectual-property, sector-specific, and other applicable laws
- Avoid representing AI output as guaranteed, human-authored, or professionally verified when it is not
When you determine why and how visitor personal data is collected through your chatbot, you are responsible for that processing as the relevant business or data controller. Orkata processes visitor data to provide the Service and may process limited data for security, abuse prevention, billing, and legal compliance as explained in the Privacy Policy.
4. Customer content and permissions
Customer Content includes files, website content, Text and Q&A sources, prompts, chatbot settings, plugin configurations, messages, form definitions, evaluation content, images, and other material submitted through your account.
You retain your rights in Customer Content. You grant Orkata a worldwide, non-exclusive, limited license to host, copy, extract, transform, embed, index, transmit, display, and otherwise process Customer Content only as reasonably needed to operate, secure, support, and improve the Service, comply with law, and enforce these Terms.
You represent that:
- You own Customer Content or have sufficient permission to use and provide it
- Importing a website does not violate the website owner’s rights, access restrictions, or applicable law
- Customer Content and your instructions do not unlawfully disclose personal, confidential, or proprietary information
- You have the authority to configure any external URL, API, webhook, credential, or integration used by a plugin
Orkata does not use Customer Content or chat logs to train Orkata-owned foundation models. External AI providers process content required for responses, embeddings, evaluations, and related features as described in the Privacy Policy.
5. AI models and outputs
AI output is probabilistic and can be inaccurate, incomplete, outdated, offensive, or unsuitable. Similar inputs can produce different outputs, and regenerated answers are not necessarily better. Retrieval from a knowledge source does not guarantee the final answer will be correct.
You must independently review output before relying on it for important decisions. The Service is not a substitute for legal, medical, financial, safety, employment, or other professional advice. You may not use the Service as the sole basis for decisions that create legal or similarly significant effects for a person where human review or additional safeguards are required.
Subject to applicable law and third-party rights, you may use output generated for your account. We do not guarantee that output is unique or that another user will not receive similar output.
Models are accessed through OpenRouter and downstream providers. A selected model can become unavailable, restricted, deprecated, or replaced with an allowed fallback. Different providers have different processing and retention practices.
6. Knowledge sources and website import
Supported source formats, upload limits, crawl limits, and storage limits are shown in the Service or documentation. Files and public website pages must contain readable text. You are responsible for verifying extracted content and removing outdated or conflicting sources.
Website discovery and recrawl are limited to public HTTPS content and may fail because of website restrictions, dynamic rendering, blocked requests, redirects, content changes, or technical limits. You may not use Orkata to bypass authentication, paywalls, access controls, robots restrictions where legally binding, or private-network protections.
7. Plugins, forms, and external systems
Plugins can cause data or actions to leave Orkata:
- A Custom Button can direct visitors to a third-party website, email address, or telephone link.
- A Form sends validated visitor values to the public HTTPS webhook you configure. Orkata does not store those field values as Leads, but stores a limited submission receipt.
- An HTTP Request sends configured inputs to your API and may return data to the selected AI model.
You are solely responsible for the legality, security, accuracy, availability, and behavior of your endpoints and destinations. You must use endpoints you control or are authorized to use, validate and authenticate requests server-side, limit returned data, rotate exposed credentials, apply appropriate rate limits, and provide any required visitor notice.
Do not place secrets in visitor-visible fields, generated responses, public links, or source content. Server-side plugin headers are still your responsibility. Orkata may disable an integration that creates security, abuse, legal, or operational risk.
8. Plans, credits, storage, and payments
Plans can include limits for chatbots, knowledge storage, model access, branding, and monthly AI credits. Current limits and prices are displayed on the Pricing or Billing page and can change prospectively.
- Dashboard, comparison, regeneration, and public visitor responses consume the account owner’s credits according to the selected model’s credit multiplier.
- Credits reset with the billing cycle, do not roll over unless expressly stated, are not transferable, and have no cash value.
- A generation that fails or is aborted may qualify for an automatic credit restoration. Technical recovery is best-effort, and Orkata’s usage records govern the account balance unless we identify an error.
- When credits or storage are exhausted, affected features can become unavailable until the limit resets, content is deleted, or the account upgrades.
When online checkout is enabled, payments are processed with Midtrans Snap. Paid subscriptions currently use manual renewal; Orkata does not automatically charge the account for the next cycle. A plan can become past due and later downgrade to the Free plan when renewal is not completed within the displayed period or grace window.
You are responsible for applicable taxes, payment-method charges, and accurate billing information. Except where required by law or agreed by us in writing, completed plan payments are not automatically refundable. Contact support promptly for duplicate charges, incorrect amounts, or payment errors. Price changes apply to future purchases or renewal cycles and do not retroactively change a completed transaction.
9. Acceptable use
You may not use the Service to:
- Break the law, violate another person’s rights, or facilitate fraud or deception
- Upload, collect, infer, disclose, or sell personal data without a lawful basis and appropriate notice
- Exploit or endanger children or process children’s data without required authorization and safeguards
- Generate or distribute malware, phishing, spam, credential theft, or instructions primarily intended to compromise systems
- Probe, scan, overload, disrupt, reverse engineer, or bypass security, rate limits, plan restrictions, or access controls
- Access private networks, private pages, or third-party systems without authorization
- Impersonate a person or misrepresent AI output as an official human decision
- Make unlawful discriminatory, high-risk, or solely automated decisions about employment, credit, housing, insurance, healthcare, education, legal rights, or access to essential services
- Submit content that is infringing, defamatory, unlawfully confidential, or intentionally harmful
- Resell, sublicense, or provide the Service as a competing platform without written permission
We may investigate suspected misuse and suspend or limit access when reasonably necessary to protect the Service, users, providers, or third parties.
10. Privacy and data protection
Our Privacy Policy explains how Orkata handles personal data. You agree to comply with applicable data-protection law and to assist with valid visitor or data-subject requests relating to your chatbot.
If you need a data-processing agreement, specific retention configuration, processing-location commitment, model-provider restriction, or regulated-industry terms, contact us before using the Service for that data. Standard self-service plans do not include those commitments unless confirmed in writing.
11. Orkata intellectual property
The Service, software, design, documentation, branding, and underlying technology are owned by Orkata or its licensors and are protected by applicable law. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service during your account term. They do not transfer ownership of Orkata technology.
If you provide feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly as the source without permission.
12. Third-party services
The Service depends on providers and systems we do not control, including Google, OpenRouter, downstream AI model providers, Midtrans, Resend, customer-configured APIs, imported websites, and linked destinations. Their terms and privacy policies can apply to their part of the service.
We are not responsible for third-party content, availability, decisions, security, or conduct. We may change providers or stop supporting an integration when reasonably necessary.
13. Suspension, termination, and deletion
You may stop using the Service at any time. You can delete sources, conversations, plugins, or an agent through available dashboard controls. Contact support for account-level deletion, billing-record requests, or access issues.
We may suspend, limit, or terminate access if:
- You materially breach these Terms or applicable law
- Payment is overdue or disputed
- Your use creates security, fraud, abuse, legal, or infrastructure risk
- A provider or authority requires the action
- Continuing the Service is no longer commercially or technically reasonable
When practical, we will provide notice and an opportunity to remedy the issue. Immediate action may be necessary for urgent risk. After termination, access ends and data may be deleted or retained as described in the Privacy Policy and as required for billing, security, legal compliance, or disputes.
Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, indemnity, disputes, and retained-data provisions—will survive.
14. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
We do not guarantee that a chatbot will retrieve the correct source, produce an accurate answer, trigger the intended plugin, meet a business outcome, or remain compatible with every website or browser. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
15. Limitation of liability
To the fullest extent permitted by law, Orkata will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for lost profits, revenue, business, goodwill, data, or opportunities arising from the Service, AI output, customer content, third-party providers, or integrations.
To the fullest extent permitted by law, Orkata’s aggregate liability arising from the Service will not exceed the greater of:
- The fees you paid to Orkata during the six months immediately before the event giving rise to the claim; or
- IDR 1,000,000.
These limits do not apply where liability cannot be limited under applicable law. You are responsible for maintaining copies of important content and for reviewing AI output before relying on it.
16. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold Orkata and its personnel harmless from third-party claims, losses, and reasonable costs arising from your Customer Content, chatbot, plugins, integrations, violation of these Terms, violation of law, or infringement of another person’s rights.
17. Changes to the Service or Terms
We may change the Service and these Terms. When a Terms change is material, we will update the effective date and provide reasonable notice through the Service, email, or another appropriate channel. Changes apply prospectively from their effective date. If you do not agree, you must stop using the Service before the revised Terms take effect.
18. Governing law and disputes
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles. Before filing a claim, each party will attempt in good faith for 30 days to resolve the dispute by contacting the other party. If the dispute is not resolved, it may be submitted to a court of competent jurisdiction in Indonesia, unless applicable law requires another forum.
19. General terms
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A delay in enforcement is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, asset transfer, or operation of the Service. These Terms, the Privacy Policy, and any applicable order or written agreement form the entire agreement for the Service and replace prior discussions about the same subject.
